I don't think it is fair because there are a lot of technicalities in contracts that should be altered depneding on the situation. The technecality with the Walmart situation is ridiculous, Walmart should not see one bit of that poor unfortunate woman's money. Her life is ruined and Walmart is completely taking advantage of her. This relates to how the human race is rude and care only about themselves. Greed is overpowering the country and something needs to be done desperately.

There also seems to be a lot of slipping through the cracks. However, I don't feel as though I am in a position to critique or praise the legal system when I really don't know much about it and wouldn't know any proper solutions.

The Defense of Marriage Act stated that states don't have to give full faith to other states with marriage licenses with regards to gay marriage.

For example the case where the woman had to pay Wal-mart the 400,000 dollars she was awarded from the accident. Now that may have been a just decision but it also was immoral to do that to a woman who needs the money. I think the justice system needs a little reform to become a more moral system.
Money makes the world go round. That is no different for the legal system. The more money you have the more likely you are to get a good lawyer and get off any charge. Look at OJ Simpson. Most public defenders are a joke and do not adequately defend their clients because they are overburdened with many cases.
In comparison with the legal systems of other nations and countries, I believe our legal system to be quite fair. Each person in this country is entitled to due process of law, a concept that most other nations do not follow. Americans are protected by our legal system and are considered "innocent until proven guilty" by trial. Each person has the opportunity to bring representation to court, something that may be unheard of in places other than America. How many other places can you think of that have legal systems that apply these three rules specifically in order to protect the "liberty" of their citizens?
I think that the basis of our legal system is fair, but there are a lot of ways that people can cheat the system to get what they want and make it unfair for others. For example, the process the court system follows is very fair because it is stable and consistent, but there are ways that people can plead their case to make the outcome come out how they want it to.
I feel as if our legal system was created to be fair but it hasn't fully succeeded. There are too many technicalities and loop holes. I agree with the fact that people are innocent until proven guilty, but many people are forced to be concidered guilty when they aren't. Recently there was a court case where the evidence pointed to this guy saying that he murdered a coworker. After spending 20 years in jail new evidence was discovered that led detectives to believe that his alibi was indeed legit and now he has been released. What does the legal system do now? It just caused an innocent person to lose 20 years of their life.

But honestly how mush more fair can a legal system get when when convicted of a crime a person gets judged by a random assembly of strangers that hear both sides of the story and make an educated decision. So until we can make a device to see into the past and see who really commits a crime our legal system is as fair as it can get for now.

If a person commits a crime and is tried for it, odds favor that crimminal of being convicted. Every person is given a fair trial, and if not, they have to right to appeal and recieve a new trial.
